The regulation amending the Regulation on the Rights of Airline Passengers (the 'Regulation') was published in Official Gazette No. 32748 on December 10, 2024, and came into effect on the same day.
With the amendment, a new paragraph has been included to the Article 7, which regulates the flight delays. Accordingly, if the flights are delayed due to technical or operational reasons, resulting in the passenger reaching the final scheduled destination with a delay of 3 hours or more, the air carrier operating the flight shall promptly fulfill the obligations specified in Articles 8 and 9.
Article 8 of the Regulation governs the right to compensation, while Article 9 addresses the right to reimbursement and itinerary changes.
Furthermore, the first paragraph of Article 8 of the Regulation has been amended. Under the revised version, passengers shall be entitled to compensation as follows:
For domestic flights: 100 Euros.
For international flights:
a) 250 Euros for flights of 1500 kilometers or less,
b) 400 Euros for flights between 1500 and 3500 kilometers,
c) 600 Euros for flights exceeding 3500 kilometers
When calculating the Turkish Lira equivalent of compensation, the foreign exchange selling rate of the Central Bank of the Republic of Türkiye on the day the compensation is paid shall be used as the basis.
